What is Publicity?
Publicity means the openness and clarity of something. It forms the basis of the principle of publicity in the Land Registry and Cadastre terminology.
The principle of publicity in the land registry means that the land registry information is only available to the relevant persons. This principle is protected by the Turkish Civil Code. Anyone who proves to official institutions that they are related to the subject can request information from the land registry officer regarding the title deed in the land registry and see the documents.
The principle of publicity in the deed also includes the right of the deed owner not to declare that he is ignorant about the current situation. Because, in the Turkish Civil Code, it is not an acceptable justification for people to declare that they have no knowledge of the land registry records they are related to.
The principle relates only to the main registers. Registry review of owners, liens and creditors can only be done by land registry officers. In short, persons related to the deed of a property cannot declare that they are unaware of this situation in the courts if there is a pledge or mortgage on the deed.
