What is Sublease?
The process of renting a workplace to someone else by giving the right to use the fixtures in it is called sublease. This method, which is generally preferred in the transfer of rental businesses, can be carried out with the written consent of the real estate owner. According to the Turkish Code of Obligations, the owner of the real estate has no right to object to the sublease unless there is a valid reason. The person who takes over the real estate becomes the party in the lease agreement. The person who subleases the workplace shall be jointly and severally liable with the new tenant for a maximum of two years.
The new tenant has the right to use all the fixtures and existing facilities in the real estate. However, the fixtures belong to the real estate owner. The person who rents a workplace for a long time, transfers the right of use to another person, thereby ending his debts to the owner of the real estate.
