Before starting the construction, a construction contract is signed between the land owners and the contractor. With this contract, it is guaranteed that the contractor and the real estate owners will fulfill their responsibilities within the specified period.<\/p>\n<p>It is not enough for the real estate owner and the contractor to notarize the contract they have drawn up between them. Since the land in return for flat contract is in the nature of a promise to sell contract, it must be issued by a notary public in order to have legal validity.<\/p>\n<h2>Which Articles Are Included in the Land for Flat Contract?<\/h2>\n<p>The land contract contains conditions that impose responsibilities on the parties. Some of the conditions that should be clearly stated in the contract are:<\/p>\n<ul>\n<li>When will the foundation license be obtained?<\/li>\n<li>Completion time of the building<\/li>\n<li>Who will cover the damage caused to third parties during the building construction process?<\/li>\n<li>Quality of materials to be used in apartments<\/li>\n<li>Punitive action to be applied in case of non-compliance with the terms of the contract<\/li>\n<\/ul>\n<p>In addition, if the zoning status changes and an additional floor permit is granted, information on who will be entitled to the new flats that can be built in the building is also included.<\/p>\n<h2>What are the Termination Conditions of the Land Contract in return for Flat?<\/h2>\n<p>If a faulty or incomplete situation is observed during the construction, the land owner may notify that the defect will be corrected within a certain period of time, and that if it is not corrected, it will transfer the construction of the building to another contractor.<\/p>\n<p>According to article 473 of the Turkish Code of Obligations numbered 6098, when it is clear that the contractor will not be able to complete the construction, the land contract for flat may be terminated. In order to terminate the contract, an action for termination must be filed. In this case, there is no need to wait for the construction completion period to terminate the contract. However, if it is understood that the construction cannot be completed within the time specified in the contract due to a situation arising from the land owner, the contract cannot be terminated.
