In case one or all of the stakeholders want to allocate their own shares, a lawsuit must be filed for the dissolution of the partnership. The lawsuit for the dissolution of partnership, also known as Izale-i \u015euyu, is a procedure that gives all stakeholders the rights they have. In other words, even if a single stakeholder has filed the lawsuit against other shareholders, property division is made in proportion to the shares that are entitled as a result of the lawsuit.<\/p>\n<h2>What are the Conditions of the Case for Dissolution of the Partnership?<\/h2>\n<p style=\"text-align: justify;\">In order for the Izale-i Shuyu case to be heard, it is necessary to apply to the competent Civil Court of Peace in the region where the real estate is located. It is sufficient for a shareholder to file the lawsuit. The defendant is the other shareholders. Everyone who has a right to shared ownership should be involved in the lawsuit. If one of the shareholders dies, the person specified as the heir is included in the lawsuit. The plaintiff party may waive the lawsuit. However, even if he has waived, he can file a lawsuit for the dissolution of the partnership again later.<\/p>\n<h2>Which Ways Can Be Followed to Eliminate Stakeholders?<\/h2>\n<p style=\"text-align: justify;\">Following the filing of the lawsuit, an expert is appointed by the court to examine whether the real estate in question can be shared or not. In the case of Izale-i \u015euyu, the parties can decide among themselves how they will share the real estate and present it to the judge. If all shareholders agree on the sharing, a decision can be made in this direction. When there is no agreement on how to share, two different methods can be followed: Exactly partition, that is, sharing the shares or dissolving the partnership through sale.<\/p>\n<p style=\"text-align: justify;\">The real estate can be divided between the parties in proportion to the shares. If it cannot be shared, it is ensured that the shareholders get their rights through sales. The sale is carried out by the enforcement office or the sales officer. Only shareholders can participate in the sale by auction if there is a consensus.
