Law No. 6506 on the Protection of the Consumer states that the seller is responsible for the defective goods and the buyer has some rights in this case.<\/p>\n<h2>What are the Features of the Defective House?<\/h2>\n<p>Although the scope of the definition of defective goods specified in the 8th article of the relevant law is wide, the following examples can be given to the defective house:<\/p>\n<ul>\n<li>Not having the plumbing projects of the house such as electricity, natural gas and water<\/li>\n<li>Presence of deep cracks that may pose a danger in the columns and beams of the house<\/li>\n<li>The house is not in compliance with the zoning plan<\/li>\n<li>No building permit<\/li>\n<li>Fire ladders and elevators are not built in accordance with the legislation.<\/li>\n<li>\u00a0The building does not have balcony and roof expenses.<\/li>\n<li>\u00a0Mortgage of the house<\/li>\n<li>No static reinforced concrete project<\/li>\n<\/ul>\n<h2>What are the Rights of the Buyer in the Defective Housing?<\/h2>\n<p style=\"text-align: justify;\">If the buyer of the property realizes that the house is defective, he must report it within 30 days after the sale. This notice must be made to the seller via a notary public or registered letter with return receipt requested. After notifying the seller, a defective goods lawsuit can be filed.<\/p>\n<p style=\"text-align: justify;\">Defects that are known as hidden defects, which are revealed as a result of use or an expert&#8217;s examination, can be reported within 5 years. 5 years is the statute of limitations for defective housing. The consumer rights in the defective house specified in the 11th article of the relevant law are as follows:<\/p>\n<ul>\n<li>Termination of the contract, that is, returning the sold real estate<\/li>\n<li>Demanding a discount at the rate of defects from the sales price<\/li>\n<li>Requesting the repair or defect to be corrected and payment of the costs from the seller<\/li>\n<li>Replacing the house with another house with the same characteristics<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The consumer can use only one of these rights. According to Article 12 of the Law on the Protection of the Consumer, if the defects in the dwelling are grossly defective or concealed by fraud, the 5-year statute of limitations does not apply.
